Welcome to On Call Legal, Inc. (“On Call Legal,” “we,” “our,” or “us”). These Terms and Conditions (“Terms”) govern your use of our website, platform, and services (collectively, the “Services”). Messaging Services and Compliance with A2P Regulations


On Call Legal may provide SMS and messaging services, including Application-to-Person (A2P) messaging. To ensure compliance with industry regulations, you agree to the following:

A. User Consent & Opt-In Requirements

  • You will only send messages to recipients who have explicitly opted in to receive communications from you.

  • Opt-in methods must be clear, documented, and verifiable (e.g., web forms, SMS keyword subscriptions, written consent).

  • You must provide recipients with a clear description of the type and frequency of messages they will receive.

B. Opt-Out Mechanism

  • Every message you send must include opt-out instructions (e.g., “Reply STOP to unsubscribe”).

  • When a user opts out, you must immediately stop sending messages to that recipient.

  • You must process opt-out requests promptly and maintain an up-to-date suppression list.

C. Message Content Restrictions

You must not use our Services to send messages that contain:

  • Unsolicited marketing or spam

  • Fraudulent, misleading, or deceptive content

  • Hate speech, violence, discrimination, or harassment

  • Obscene, pornographic, or adult content

  • Illegal activities, such as drug sales, gambling, or unlicensed financial services

  • High-risk or prohibited categories as defined by mobile carriers and regulators

D. Compliance with Laws and Carrier Guidelines

You agree to comply with all applicable laws and industry guidelines, including:

  • The Telephone Consumer Protection Act (TCPA)

  • The CAN-SPAM Act

  • The CTIA Messaging Principles & Best Practices

  • Carrier-specific rules for A2P messaging

If required, you agree to register your messaging campaigns with carriers or regulatory bodies. Failure to comply with these requirements may result in suspension or termination of your access to our Services.

Account Registration & Security


To use our Services, you may need to create an account. You agree to:

  • Provide accurate and complete information

  • Keep your login credentials secure

  • Be responsible for all activity under your account

  • Notify us immediately of unauthorized access at [email protected]

Payment & Fees


Some Services may require payment. By purchasing a subscription or other paid services, you agree to:

  • Pay all applicable fees

  • Use authorized payment methods

  • Understand that payments are non-refundable unless otherwise stated

We reserve the right to suspend access to Services if payment is not received.

Termination & Suspension


We may suspend or terminate your account if you:

  • Violate these Terms or applicable laws

  • Engage in prohibited activities (e.g., spam, fraud, abuse)

  • Fail to pay for paid services

Upon termination, your access to our platform will be revoked, and any remaining credits may be forfeited.

Limitation of Liability


To the fullest extent permitted by law, On Call Legal is not liable for:

  • Delays or message delivery failures beyond our control

  • Losses due to misuse of the Services

  • Indirect, incidental, or consequential damages

Our maximum liability is limited to the fees paid for the Services in the last three (3) months.

Privacy & Data Protection


By using our Services, you agree to our Privacy Policy, which outlines how we collect, use, and store personal data. We do not share subscriber data with third parties for marketing purposes.

Changes to These Terms


We reserve the right to update these Terms at any time. Continued use of our Services after changes are posted constitutes acceptance of the new Terms.

Governing Law & Dispute Resolution


These Terms are governed by the laws of the State of California, United States. Any disputes shall be resolved exclusively in the state or federal courts located in Los Angeles, California.
